L’Écrin d’Argent – General Terms and Conditions of Sale Version 1.2 – Last Updated on June 12, 2025

Article 1: Purpose
These General Terms and Conditions of Sale define the conditions applicable to distance sales concluded between, on the one hand, individuals wishing to make a purchase via the website www.lecrindargent.mu (hereinafter referred to as “the Customer”), and on the other hand, the jewellery company L’ECRIN D’ARGENT LTD, whose registered office is located at Silicon Avenue, 4th Floor, The Catalyst Building, Ebene, 1721-04, registered under number C24215645 (hereinafter referred to as “L’ECRIN D’ARGENT LTD”).

Article 2: Orders
Any order placed for a product listed in the online store www.lecrindargent.mu implies prior consultation and acceptance of these General Terms and Conditions of Sale.
Order validation constitutes full acceptance of these terms. This validation click constitutes a “digital signature.”
Furthermore, L’ECRIN D’ARGENT reserves the right to refuse any order from a Customer with whom there exists a dispute relating to payment of a previous order.

Article 3: Proof of Transaction
Computerised records stored in L’ECRIN D’ARGENT’s IT systems under reasonable security conditions shall be considered proof of communications, orders, and payments between the parties.
Order forms and invoices are archived on reliable and durable media that may be produced as evidence.

Article 4: Product Information
Every effort has been made to ensure the accuracy of the information presented on www.lecrindargent.mu .
Gemstones may have undergone treatments intended to enhance their colour and clarity.
Product photographs and descriptions are non-contractual.

Article 5: Prices
Our prices apply to private individuals. All prices listed in the catalogue are indicated in Mauritian Rupees (MUR).
L’ECRIN D’ARGENT reserves the right to modify its prices at any time without prior notice, it being understood that the price displayed on the day of the order shall be the only price applicable to the Customer.
Shipping costs and the total amount inclusive of all taxes (VAT included) are indicated prior to order confirmation.
Prices invoiced are those in effect at the time of the order.
All prices are net of any discount and may be modified without prior notice.
All prices displayed on www.lecrindargent.mu are valid exclusively online.

Article 6: Payment Methods
Unless otherwise agreed, all sales are payable in full at the time of purchase (no discounts or rebates).
L’ECRIN D’ARGENT offers payment by Visa, Eurocard, Mastercard, and bank transfer..
Goods will be dispatched upon authorisation of card payment or credit to L’ECRIN D’ARGENT’s bank account.
Payment is fully secure.
Transactions are processed and secured by the XXXXX solution.
The website uses a secure TLS (Transport Layer Security) payment module, protecting against hacking attempts.
All banking data is encrypted.
Customer banking details never pass through our website and are therefore not stored on our servers.

Article 7: Retention of Title
Goods remain the property of L’ECRIN D’ARGENT until full payment has been received and must remain in their original condition until paid in full.

Article 8: Delivery Terms
Products are delivered to the address indicated by the Customer on their online account.
We work with a carrier enabling delivery within 72 hours from payment authorization or credit confirmation, subject to product availability.
Delivery times are indicative only. Delays shall not give rise to damages, withholding of payment, or cancellation of orders.
All products leave our premises in perfect condition.
The Customer must report to the carrier any visible damage (holes, crushing marks, etc.) on the package and, where appropriate, refuse the parcel.
Any product declared damaged after delivery, without reservations noted upon receipt, will not be eligible for exchange.
In the event of delay or loss during shipment, we will initiate an investigation with the carrier. Every effort will be made to locate the parcel.
We decline all responsibility for delivery delays caused by the carrier, including loss, weather conditions, or strikes.

Article 10: Delivery Issues Caused by the Carrier
Any anomaly (damage, missing items, damaged parcel, broken products, etc.) must be indicated on the delivery slip as a handwritten reservation, signed by the Customer.
The Customer must also notify the carrier by registered letter with acknowledgment of receipt within two (2) working days of delivery.
A copy must be sent by email to: contact@lecrindargent.mu . Without this procedure, no exchange will be processed.

Article 11: Delivery Errors
Any claim relating to delivery errors or non-conformity must be made on the day of delivery or no later than the next working day. .
Any claim submitted after this period shall not be accepted.

Any claim not made in accordance with these conditions and deadlines will not be accepted.
Products must be returned complete, in their original packaging and in perfect condition, to: Silicon Avenue, 4th Floor, The Catalyst Building, Ebene, 1721-04.
Returns require prior approval from L’ECRIN D’ARGENT.
Return shipping costs will be borne by L’ECRIN D’ARGENT unless the product does not correspond to the Customer’s declared reason for return.

Article 12: Product Warranty
In the event of non-conformity, products may be returned, exchanged, or refunded.
Jewellery Warranty: Except in cases of misuse or negligence, our jewellery is guaranteed for 12 months from the date of purchase against manufacturing defects.

Article 13: Returns
Any return of defective goods must be authorised in advance by our after-sales service at: contact@lecrindargent.mu .
A return authorisation number will be issued.
Products must be returned complete, properly packaged, by registered mail or signed delivery, with postage paid.
Any return not complying with this procedure will be refused.

Article 14: Intellectual Property
All reproduction rights are reserved, including for downloadable documents and photographic content.
Reproduction of all or part of this website on any medium is strictly prohibited without prior written authorisation from the publication director.

Article 15: Force Majeure
www.lecrindargent.mu shall not be held liable in cases of force majeure.
In such cases, the Customer will be notified within seven (7) working days.
The Parties shall consult to determine how to proceed during the force majeure period.
After one (1) month of interruption due to force majeure, www.lecrindargent.mu may cancel the order and refund the Customer if applicable.

Article 16: Jurisdiction and Applicable Law
These Terms are governed by Mauritian law.
If any provision is deemed invalid, the remaining provisions shall remain in full force and effect.
In case of interpretation difficulty, clause titles shall have no legal value.

Article 17: Personal Data Protection
All data provided by the Customer is collected solely for order processing and is for exclusive internal use. .
The Customer has the right to access, rectify, modify, and delete their personal data.

Article 18: Disputes
Any order placed via www.lecrindargent.mu implies full and unconditional acceptance of these Terms and Conditions
In the event of dispute, any matter relating to sales (price, terms, products, etc.) shall be governed by Mauritian law and submitted to the competent court.
